This Terms of Use Agreement (“Agreement”) constitutes a legally binding contract between RequestLab (“RequestLab”, “we”, “us”, or “our”) and you, the client (“Client”, “you”, or “your”), whether personally or on behalf of an entity, regarding your access to and use of the website https://requestlab.online (the “Website”) and related platforms. By accessing or using our Website, you agree to be bound by all the terms, conditions, and policies stated here. If you do not agree, you must discontinue use immediately.

1. Intellectual Property Rights

All content, source code, features, and designs on the Website—including trademarks, logos, text, graphics, audio, video, and software—are owned or licensed by RequestLab and are protected by intellectual property laws. You may not use, reproduce, distribute, or exploit any part of the Website without our prior written consent.

2. Ownership of Materials

All design work and original files created for you (“Projects”) are your exclusive property. RequestLab irrevocably assigns all rights to the final Projects to the Client, unless otherwise agreed. Any material provided by the Client must not infringe third-party rights. RequestLab reserves the right to showcase completed work unless a prior NDA has been signed.

3. Third-Party Fonts

If any Project includes fonts requiring separate licenses, RequestLab will notify you. It is your responsibility to purchase the appropriate licenses. We assume no liability for any unlicensed font use after delivery.

4. User Representations

By using our Website, you warrant that:

  • You have legal capacity to enter into this Agreement
  • You’re not a minor in your jurisdiction
  • You will not use the Website for any unlawful purpose
  • You will comply with all applicable laws

5. Prohibited Activities

You agree not to:

  • Use the Website for unauthorized or unlawful purposes
  • Reverse engineer, copy, or exploit our content or technology
  • Upload viruses or harmful code
  • Harass or intimidate RequestLab employees
  • Circumvent security features
  • Use the Website in competition with RequestLab

6. Client Feedback

Any suggestions, comments, or ideas (“Submissions”) you share with RequestLab become our property. We may use them without compensation or obligation to you, unless related to your Project as described in Section 2.

7. Management and Oversight

We reserve the right to monitor, restrict, or terminate your access to the Website at our sole discretion and without prior notice if we determine that you have violated these Terms.

8. Privacy Policy

Use of our Website is subject to our Privacy Policy. By using our Website, you consent to the data practices outlined therein.

9. Returns and Refunds

Refunds are granted at RequestLab’s discretion. If a refund is issued during the first month, all work created remains our property and may not be used by the Client. A 25% fee applies to the remaining billing cycle, and payment processor fees are non-refundable.

10. Modification

We reserve the right to change any part of the Website or these Terms at any time without notice.

11. Connection Interruptions

We do not guarantee uninterrupted access to the Website. We are not liable for service disruptions beyond our control.

12. Governing Law

These Terms shall be governed by the laws of the Republic of Namibia, unless otherwise specified.

13. Litigation

Any legal action shall be brought in the courts of Namibia. By using this Website, you waive any jurisdictional objections.

14. Disclaimer

The Website is provided “as is.” We make no warranties about the accuracy or completeness of any content and are not liable for any errors, omissions, viruses, or damages from its use.

15. Limitation of Liability & Indemnification

RequestLab shall not be liable for indirect or consequential damages, including lost profits or data. You agree to indemnify us against any claims arising from your use of the Website or violation of these Terms.

16. User Data

You are solely responsible for your data and any consequences arising from its transmission. We are not liable for data loss.

17. Electronic Communications & Signatures

You consent to receive communications electronically and agree that electronic contracts, signatures, and transactions have the same legal force as written documents.

18. Licensing

You are responsible for ensuring all third-party content used in your materials (fonts, stock images, etc.) is properly licensed, unless explicitly stated otherwise in writing by RequestLab.

19. Showcasing Client Work

RequestLab may display completed client work on our digital platforms unless you request otherwise in writing or have a signed NDA in place.

20. Referrals

Referral tracking and rewards are managed via our third-party partner: Rewardful.com.

21. Miscellaneous

These Terms constitute the full agreement between you and RequestLab. If any part is deemed unenforceable, the remainder remains in effect. No joint venture or employment relationship is created by this Agreement.
